There is not getting around it. Once you get that divorce you have to be really proactive in making sure your ex does what he or she is supposed to in as far as the debt goes. When i was a debt collector I would usually make a deal with them that they only have to pay 1/2 and I would remove it from their report, but I hear now that banks don’t care who they go after as long as they get ALL their money.

I see this question every month and most people do not realize that lenders are not bound by divorce decrees. The only way for her to be relieved of obligation for the debts would have been for her divorce decree to have stated that the ex-husband had to re-finance the debt is his name only.

In my job, I have to deal with this every month. People come in and want to buy a car, but when I pull their credit there is a repossession. They produce a divorce decree stating that their ex was responsible for it, and every time I get the same answers from my lenders. As long as it shows on their credit that they are responsible for the loan, then they are. No exceptions.

I have excellent credit but my fiancee does not. His credit was ruined when he got divorced and still is paying off accounts from a couple of years ago. I don’t want to be responsible for anything he had prior to me marrying him. How can I protect my name/credit when I get married? I don’t want his credit to impact me while he is cleaning his up.
