Ways to Avoid Foreclosure Scams

When a lender files a foreclosure against you because you’ve missed on your payments, it can be a very difficult situation for you. The thought of losing your home is indeed very stressful and frustrating. However, on these moments, you need to keep up your composure to avoid committing any false moves that can only worsen your situation.
In fact, some people take advantage of home owners who are facing foreclosure because they know that they will do anything to save their property. For this reason, you need to be especially careful about accepting such offers of help. To be safe, it’s best to consult a reputable lawyer before entering any agreement with anyone. Here are some points you need to remember when dealing with pre-foreclosure:
Maintain composure. When you first receive a notice of foreclosure to your property, don’t panic. Don’t make any sudden decisions that can turn out to be a mistake. Instead, get all the information necessary especially the exact date of your property’s foreclosure and study the situation carefully.
Talk to your lender immediately. Explain your current financial situation to your lender and the reasons why you missed payments on your mortgage. Be honest; hiding facts from your lender will not help you solve the problem. Request for forbearance or if it is possible to make adjustments on your payment terms to make it easier for you to repay. Most lenders are willing to extend help for their clients especially if they have been good payers in the past. However, bear in mind that it is not your lender’s obligation to extend you such consideration. Always be courteous and professional when expressing your concerns to your lender.
Take a good look at your financial situation. Study the possible measures you can take so you can make repayments on your mortgage. Is there some way to earn additional income? Are there some things you can give up to save some money? Do you have relatives who can lend you the money for the reinstatement of your mortgage? If there are no other options, do you need to sell your property before the actual foreclosure?
Do not hand over any payment to anyone except your lender. If someone offers to submit the payments on your behalf, say no at once. When it comes to matters of payment, you should only be contacting your lender, not anyone else.
Never sign any contract without your lawyer. When people find out you’re property is facing foreclosure, you might receive offers that promises to help you buy back or lease back your home. Watch out for contracts that have blank lines or spaces in them where it is easy to make up additional terms against your will. Never sign up any agreement that makes such promises especially without having your lawyer check on the legalities and terms of the contract.
If you’re selling your property, make sure that a lawyer is present in your closing. Your lawyer must see to it that all the terms in the contract is legal and that it releases you from any liability on your mortgage.
